Terms of service
These terms apply to the GexPilot subscription. By ordering, you accept them.
1. Provider
GexPilot, operated by Linus Schenker and Nils Bürki, Gibelweg 5, 9442 Berneck, Switzerland, email support@gexpilot.com (hereinafter "GexPilot").
2. Service
- On US trading days, subscribers receive GEX levels before the US market open (9:30 a.m. New York time), for example call wall, put wall, gamma flip and the strongest strikes, converted to MNQ and NQ, with a short briefing. Delivery via [CHANNEL, e.g. email, Discord or Telegram].
- The TradingView indicator is free and not part of the subscription.
- The levels are based on third-party data and calculations. GexPilot aims for punctual and error-free delivery but guarantees neither availability nor accuracy. On US holidays or if data sources fail, delivery may be delayed or skipped. Individual outages do not entitle you to a price reduction.
- GexPilot may develop the content of the levels further as long as the core of the service remains.
3. Not investment advice
The levels are general, non-personalised information. They are not investment advice, not a recommendation and not a financial service within the meaning of the Swiss Financial Services Act (FinSA). You make your own trading decisions and are responsible for them. The risk disclosure applies.
4. Conclusion of the contract
- The contract is concluded when you complete the order on the checkout page and payment succeeds. Before ordering you see all details and can correct them. You receive a confirmation by email.
- You must be at least 18 years old.
- Payment is processed by [PAYMENT PROVIDER, e.g. Stripe or Lemon Squeezy]. Its terms also apply.
5. Prices and payment
- The price shown at checkout applies. Prices in CHF are final prices; GexPilot is not registered for VAT. Any taxes the payment provider charges to customers outside Switzerland are shown before purchase.
- The subscription is paid monthly in advance and renews automatically for another month until you cancel.
- A founder price applies under the conditions stated at purchase. After that, the regular price applies.
- GexPilot announces price changes at least 30 days in advance by email. They apply from the next billing period after that notice. If you do not agree, you can cancel before then.
6. Term and cancellation
- You can cancel at any time, effective at the end of the current billing period, via the "Cancel subscription" link on the website or in any invoice email, or by email to support@gexpilot.com.
- Periods already paid are not refunded pro rata, subject to section 7.
- GexPilot may terminate the subscription with 30 days' notice to the end of a period, for example if the service is discontinued. In case of a breach of section 8, termination without notice is possible.
7. Right of withdrawal and money-back guarantee
Customers resident in Switzerland: Swiss law provides no statutory right of withdrawal for online subscriptions. GexPilot voluntarily offers a money-back guarantee: if you cancel by email within 14 days of your first purchase, you get your first monthly payment back.
Consumers resident in the EU or EEA: You have the right to withdraw from this contract within 14 days without giving any reason. The period begins when the contract is concluded. To withdraw, a clear statement by email to support@gexpilot.com is enough, for example: "I hereby withdraw from my GexPilot subscription of [date]. Name, email address." We refund all payments within 14 days of receiving your withdrawal using the original payment method. If you requested at purchase that delivery of the levels begins immediately, you pay a proportionate amount for the period up to your withdrawal. The money-back guarantee for Swiss customers also applies to you if it is more favourable.
8. Rights of use
- The levels are for your personal use only.
- You may not pass them on, publish, resell or share them in groups, channels or on social media. Access to the subscription may not be shared with others either.
- In case of a breach, GexPilot may end the subscription without refund and claim damages.
9. Liability
GexPilot is not liable for trading losses, lost profits, consequential damages or damages caused by late, missing or incorrect levels. Liability for unlawful intent and gross negligence remains reserved (Art. 100 Swiss Code of Obligations), as do mandatory consumer protection provisions. Otherwise, liability is limited to the amount you paid in the last 12 months.
10. Privacy
The privacy policy applies.
11. Changes to these terms
GexPilot may change these terms. Changes are announced by email at least 30 days in advance and apply from the next billing period. If you do not cancel by then, they are deemed accepted.
12. Governing law and jurisdiction
These terms are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is 9442 Berneck. For consumers, the mandatory places of jurisdiction and protective provisions of their country of residence remain reserved.
